Changing technology, and the pervasive demand created by a greater need in the population for access to mental health interventions, has led to the development of technologies that are shifting the traditional way in which therapy is provided. This study investigated the efficacy of a behavioral couples therapy program conducted via videoconferencing, as compared to face-to-face. There were 60 participants, in couples, ranging in age from 21 to 69 years old. Couples had been in a relationship for between 1 to (...) 49 years. The 30 couples were randomly allocated to the face-to-face or videoconferencing group. They all took part in Couple CARE—a couples behavioral education program which promotes self-change in order to increase relationship satisfaction. The six session manualized intervention was offered in an identical manner to all clients, in each condition. Data analysis was based on several questionnaires completed by each couple at pre, post and 3-months follow-up. Results showed that therapeutic alliance ratings did not differ between groups, but increased significantly over time for both groups. Additionally, the results indicated improvements in relationship satisfaction, mental health, and all other outcome scores over time, which did not differ based on condition. This study uniquely contributes to the literature exploring the use of technology to provide therapy. Specifically, the study provides evidence for couples therapy via videoconferencing as a viable alternative to face-to-face interventions, especially for those couples who may not have access to the treatment they require. It is anticipated that the results of this study will contribute to the field of online therapy, and add to fostering confidence in agencies to allow expansion of services conducted via videoconferencing. Selection operates at many levels. Robert Brandon has distinguished the question of the level of selection from the unit of selection, arguing that the phenotype is commonly the target of selection, whatever the unit of selection might be. He uses "screening off" as a criterion for distinguishing the level of selection. Cave animals show a common morphological pattern which includes hypertrophy of some structures and reduction or loss of others. In a study of a cave dwelling crustacean, Gammarus minus, (...) we find evidence for selection for both increased antennal size and reduction of eyes. The genetic structure of the population does not support the view that the phenotype screens off the genotype in explaining the differences in fitness. Nonetheless, the results do indicate that the level of selection is at least at the level of the phenotype in both cases. (shrink)

This paper identifies a volitional theory of meaning common to speech act theory and legal positivism, represented by Hart and Kelsen. This model is compared and contrasted with the model of social operations developed by Reid, a Common Sense Enlightenment philosopher. Whereas the former subscribes to the view that meaning is generated by acts of will, the latter finds meaning to consist of the dual elements of sign and 'directedness'.The ability of positivist theories to provide a structural account of the (...) difference between legal rules and other rules is inextricably linked to this commitment to the volitional theory of meaning. The commitment to the volitional view however leads to problems in requiring that some kind of authority be presupposed in for plain rules to attain legal force. Such authority can only be established with recourse to further rules or must be accepted as a matter of faith. Reid's criterion of direction however vitiates the need for an authority, instead accounting for social communication in general, and rules in particular, in terms of sociological factors. Although no comprehensive critique of the volitional theory is proposed, Reid's model is preferable on the grounds of explanatory richness.The core claims of the paper are that: legal positivism necessarily subscribes to the volitional theory of meaning; rejection of the volitional theory necessarily entails rejection of the positivist view that legal and non-legal rules can be differentiated on structural grounds another counter-model exists which avoids some of the pitfalls of the volitional theory; if the volitional theory is rejected then the existence of rules can only be accounted for in a 'strong' sociological sense and legal theory must accordingly accept the dominant role of sociology in conceptualising the nature of rules. For students of the poet, Robert Fallon's _Milton in Government_ fills a gap in modern knowledge of his life, the ten years he labored as Secretary for Foreign Languages to the English Republic. For Interregnum historians, the book offers a study of the international affairs of the Republic from a unique perspective, as well as a detailed analysis of the government bureaucracy that conceived and articulated foreign policy during the 1650s. Milton's decade of public service to the English Republic, (...) and the collection of State Papers which are the product of those years, have been either misunderstood or largely ignored by Miltonists, and their influence upon his poetry all but dismissed. Making extensive use of the State Papers Foreign in the Public Record Office, hitherto overlooked by literary scholars, and the Calendar of State Papers Domestic, Fallon offers the first definitive description of the poet's place in government. He finds Milton to be an indefatigable and highly knowledgeable public servant, closely involved in the expression of foreign policy, and responsible for many more documents than have been previously ascribed to him. His State Letters reveal him as a man intimately aware of international events, a consideration which leaves little doubt that his experience in government had a significant influence on his creative imagination. Fallon also provides a reading of Milton's tracts of 1659–1660, tracing the influence of a decade of public service in his political philosophy and questioning historians' conclusions that he was repudiating Cromwell's Protectorate in his appeal to stave off the Restoration. In a series of radio broadcasts, one of which is translated for the first time in this issue (pp. 21-34), Adorno and Becker claimed that modern education is profoundly inadequate. Their views on education draw heavily on Kant’s notion of Enlightenment as a process for the development of personal and social maturity and responsibility. As such, education cannot just be a training but must itself be a developmental process which takes into account not only social and political realities but also (...) the complex psychodynamics involved in learning. However, Adorno and Becker arrive at a position that is close to self-contradictory, unable to solve the paradox inherent in the idea of an education that is at once authoritative and non-conformist. This might arise from their failure to reflect on the nature of their own dialogue, and it is suggested that friendship offers the social model of a dynamic relationship of the type they sought to articulate. Despite the fact that the discussion took place in 1969, in a climate of educational debate radically different from today’s, their work raises issues and poses questions of the profoundest importance 30 years on. In the updated preface to the 2008 edition of his seminal work The Sublime Object of Ideology, Slavoj Žižek writes that “when a discipline is in crisis, attempts are made to change or supplement its theses within the terms of its basic framework – a procedure one might call ‘Ptolemization’”. The alternative, he claims, is a “true ‘Copernican’ revolution” which takes place “when, instead of just adding complications and changing minor premises, the basic framework itself undergoes a transformation”. In light (...) of these remarks, the central question posed in this paper is as follows: how might Žižek’s distinction between a Ptomelization and Copernican revolution be applied to the field of Žižek Studies today? How, in other words, might we seek to re-evaluate Žižek’s work in a way that includes the mechanisms of evaluation as part of the observed phenomena? The working hypothesis is that, as Žižekians, we must reassert the fundamental rule of psychoanalysis as articulated by Žižek himself: one must remember to include as part of the content of the message communicated, the act of communication itself. In short, when it comes to the reception of Žižek’s thought we should remember Žižek’s basic point that “the question to ask is always: is this truly a Copernician revolution, or merely a Ptolemization of the old paradigm?”. A critical analysis of theories of commercial impossibility and frustration of purpose is best undertaken in conjunction with a theoretical analysis of contract in general. Contracts function as a means of transferring social benefit, which can be subcategorised into subjective and objective benefit. Contracts also regulate the transfer or risk, which is inherent in property and hence any contractual relationship. In the light of the transfer of subjective and objective benefit and risk, contracts can be shown to be by definition (...) ex ante Pareto superior for both parties. Frustration of purpose or commercial impossibility is pleaded where the ex post overall benefit differs greatly from the ex ante expected value. This difference results from the manifestation of a risk which one party bears under the terms of the original contractual risk/benefit equilibrium. Considering the various subjective and objective risks and benefits involved in the contract, it is possible to classify frustrating eventualities under eight heads. In at least six cases the importance of the principle of security of exchange clearly precludes the operation of frustration. One of the remaining cases corresponds with the controversial Krell v Henry; there appears to be a temptation to regard frustration as the most socially utilitarian solution. Given however the dynamics of contractual risk and benefit, allowing frustration there would be unworkable because it would entail placing a subjective risk burden on the party which is in a worse position to evaluate it. There should be no place in the law for a doctrine of frustration of contract on the grounds of commercial impossibility orchanged circumstances. (shrink)

Arguably the biggest challenge in analyzing English tense is to account for the double access interpretation, which arises when a present tensed verb is embedded under a past attitude—e.g., "John said that Mary is pregnant". Present-under-past does not always result in a felicitous utterance, however—cf. "John believed that Mary is pregnant". While such oddity has been noted, the contrast has never been explained. In fact, English grammars and manuals generally prohibit present-under-past. Work on double access, on the other hand, has (...) either disregarded the oddity (e.g., Abusch 1997: 39) or treated it as a reflex of a particular dialect (e.g., Kratzer 1998: 14). The goal of the paper is to argue—based on a corpus study—that a present-under-past sentence is grammatical, but modulated by two, interacting pragmatic phenomena: cessation and parentheticality. For a half - century, I have been developing a view of free will that is incompatible with determinism and, in the process, attempting to answer the Intelligibility Question about such a free will: Can one make sense of an incompatibilist or libertarian free will without reducing it to mere chance, or mystery, and can such a free will be reconciled with modern views of the cosmos and human beings? In this paper, I discuss recent refinements to my earlier writings (...) on such a view, refinements developed in recent years in response to the large critical literature on my views in the past several decades. My view has usually been designated an event-causal view of libertarian free will and distinguished from non-causal and agent-causal libertarian views. But I was never happy with this designation of my view as “event-causal” and did not use it myself in earlier writings. In this paper, I explain why I now reject it altogether. I have come to believe that to avoid numerous misunderstandings in current debates about free will, we must distinguish four different kinds of libertarian theories, not merely three: in addition to non-causal, agent-causal, and event-causal theories, we need to add a fourth kind, which might be called an agent-causal/event-causal theory. My view has always been of this fourth kind. It represents what I call in the title of this paper the “fourth way forward” for making sense of an incompatibilist free will. (shrink)

Robert Kane provides a critical overview of debates about free will of the past half century, relating this recent inquiry to the broader history of the free will issue and to vital currents of twentieth century thought. Kane also defends a traditional libertarian or incompatibilist view of free will, employing arguments that are both new to philosophy and that respond to contemporary developments in physics and biology, neuro science, and the cognitive and behavioral sciences.

This article begins with an account of some of the different views on the nature of free will which have been expressed by historically important Muslim thinkers. The views of both Muslim philosophers and theologians are addressed. It is demonstrated that some held compatibilist views while others held libertarian views. Consider the following principle: (LP) If an action is undetermined at a time t, then its happening rather than not happening at t would be a matter of chance or luck, and so it could not be a free and responsible action. This principle (which we may call the luck principle, or simply LP) is false, as I shall explain shortly. Yet it seems true.

It is now more than half a century since I first began thinking about issues of free will. The libertarian views of free will I developed over this long period have been much debated and have been refined and further developed in response to the critical literature. The goal of this book is to provide an overview of recent developments of my views along with responses to the latest critical literature on them over the past twenty-five years since the publication (...) of my book, The Significance of Free Will (OUP, 1996). Chapters 1-5 present an overview of my current view with the recent additions and alterations to it defended in greater detail. Chapters 6-10 include critical examinations of influential views of many philosophers in the past twenty-five years who have defended alternative views of free will and moral responsibility, including prominent defenders of competing libertarian views, prominent defenders of compatibilist views, free will skeptical views, revisionist views, illusionist views, and others. The goal of these chapters is not merely to criticize these views, but to show what I believe they get right and what aspects of many of them can be accommodated in the libertarian view of free will I defend here. In the final chapter 11, I relate the view of free will of earlier chapters to ethical views I have developed in other works over this same period and to the philosophy of religion, including Eastern religions (Hinduism, Buddhism) as well as theistic traditions (Judaism, Christianity, and Islam). In a recent paper in this journal, “How should libertarians conceive of the location and role of indeterminism?” Christopher Evan Franklin critically examines my libertarian view of free will and attempts to improve upon it. He says that while Kane's influential [view] offers many important advances in the development of a defensible libertarian theory of free will and moral responsibility … [he made] “two crucial mistakes in formulating libertarianism” – one about the location of indeterminism, the other about its (...) role – “both of which have helped fan the flame of the luck argument”. In this paper, I respond to Franklin's criticisms, arguing that, so far from making it significantly more difficult to answer objections about luck and control, as he claims, giving indeterminism the location and role I do makes it possible to answer such objections and many other related objections to libertarian free will. This paper responds to three critical essays on my book, The Significance of Free Will(Oxford, 1996) by Randolph Clarke, Istiyaque Haji and Alfred Mele (which essays appear in this issue and an earlier issue of this journal). This response first explains crucial features of the theory of free will of the book, including the notion of ultimate responsibility.The paper then answers objections of Haji and Mele that the occurrence of undetermined choices would be matters of luck or chance, and so (...) could not be responsible actions. It then responds to concerns of Clarke that indeterminism provides no greater degree of control for defenders of incompatibilist free will and to concerns Clarke has about the notions of "effort" and "willing" in the book. Finally, the paper addresses objections of Haji concerning Frankfurt type-examples and the relation of moral responsibility to the power to act otherwise, and it addresses a concern of Mele's about why we should want a free will that is incompatible with determinism. This second edition of The Oxford Handbook of Free Will is intended to be a sourcebook and guide to current work on free will and related subjects.

Over the past three decades, I have been developing a distinctive view of free will motivated by a desire to reconcile a non-determinist view of free will with modern science as well as with recent developments in philosophy. A view of free will of the kind I defend did not exist in a developed form before the 1980s, but is now discussed in the philosophical literature as one of three chief options an incompatibilist or libertarian view of free will might (...) take. As such, this view has been the subject of much recent discussion. In this paper, I explain and defend my view of free will, and answer recent criticisms of it. Some of these criticisms are made by Robert Allen in his paper “Self-forming Actions,” a contribution to the seminar of which the present paper is a part. I also respond to Katherin Rogers’ contribution to this seminar “Libertarianism in Kane and Anselm.” Her book, Anselm on Freedom, argues that Anselm defended a unique libertarian view of free will, avoiding both Pelagianism and Augustine’s later compatibilism, a view that she argues has affinities to my view of free will. I also discuss these affinities to Anselm in my paper and their theological and well as philosophical implications. (shrink)

Over the past half century, I have been developing and defending a libertarian view of free will that is incompatible with determinism. In the past decade, I have made changes to this view in response to the large critical literature that has developed around it since the publication of my book The Significance of Free Will (Oxford University Press, 1996). This paper describes and defends some of the more significant of these new aspects of my view. Section 1 describes the (...) problem of free will as conceived traditionally and in modern times, as well as the various competing positions on it (compatibilist, libertarian, skeptical, and so forth). In section 2 I concede to compatibilists that there are many meanings of freedom, and that many of them could exist in a thoroughly determined world. But there is one kind of traditional freedom, I argue, that could not exist in a thoroughly determined world—freedom of will. Sections 3 and 4 explain what this freedom of will requires and why it is important. Sections 5–11 then discuss and answer many arguments that have been made against the possibility of such a free will requiring indeterminism. (shrink)

Modernity has challenged the ancient ideal of a universal quest for wisdom, and today's world of conflicting cultures and values has raised further doubts regarding the possibility of objective ethical standards. Robert Kane refocuses the debate on the philosophical quest for wisdom, and argues that ethical principles about right action and the good life can be seen to emerge from that very quest itself. His book contends that the search for wisdom involves a persistent striving to overcome narrowness (...) of vision that comes from the inevitable limitations of finite points of view. When applied to questions of value and the good life, this striving has ethical implications about the way we should treat ourselves and others. This study argues for the merits of this central thesis against alternative theories in contemporary normative ethics, and discusses its practical applications for social ethics, political philosophy, law and moral education.
